Welcome to CIGAR.com Elite Advantage Program, operated by LV Penn Sales, LLC d/b/a CIGAR.com (“Cigar.com”, "we," "us” or “our”). By registering to become a member (a “Member” or “you” or “your”) of the CIGAR.com Elite Advantage Program (“Elite” or the “Program”) and by participating in the Program, you (i) represent that you are 21 years of age and (ii) agree to be bound by the Program Terms and Conditions (“Terms”). Elite Advantage membership is free. You may review these Terms at any time by clicking on the link on the Elite Advantage home page.
Elite Advantage members earn (1) Point for every $1 spent on merchandise at CIGAR.com. Points may be redeemed for Rewards based on four (4) tiers of membership as follows:
Eligibility: You must be age 21 years or older, and a resident of the United States to be eligible for membership in the Elite Advantage Program. Only one Program account is permitted per individual.
How to Join: To become a Member, eligible individuals must enroll by visiting Elite Advantage page and completing a short application form. To complete enrollment, individuals must provide their full name, phone number, mailing address, email address, and date of birth (“Registration Data”). You agree to (a) provide true, accurate, current, and complete Registration Data as prompted by the Program enrollment form, and (b) maintain and promptly update the Registration Data (found in the "My Account" section of the website) to keep it true, accurate, current, and complete. If you provide any Registration Data that is untrue, inaccurate, not current or incomplete, or if CIGAR.com, in its discretion, suspects that your Registration Data is untrue, inaccurate, not current or incomplete, CIGAR.com has the right to suspend, terminate, or refuse your current or future use of the Program.
Once enrollment has been completed, you are a Member and will start to automatically earn Points and Rewards on all merchandise at CIGAR.com. Note that, by enrolling, you are electing to receive Program emails.
Members earn one Point for every $1 spent on eligible purchases when logged into their Member accounts.Point calculations are based upon dollars actually paid at checkout on eligible purchases. Eligible purchases are regular and sale priced merchandise on CIGAR.com. No Points are earned for Gift Card purchases. Additionally, no Points are earned for payment of federal, state, or local taxes, or for payment of shipping and handling costs. Further, Points are earned net of discounts, coupons, and Reward redemptions.Points will post to Member's account three (3) days after an order is confirmed. For returns, Points previously posted to Member's account for that purchase will be deducted from Member's account.Points have no cash value and are non-transferable. Points from one Member account cannot be combined with points from another Member account.Points will be reversed on a member’s balance if earned on a product that is cancelled or returned.CIGAR.com reserves the right to change the Terms regarding the earning or redemption of Points at any time.CIGAR.com reserves the right to offer bonus and other promotional offers to select Members based on purchase activity, geographic location, program participation, and/or other factors. CIGAR.com also reserves the right to change bonus opportunities at any time at its sole discretion, with or without notice to Members.
As set forth in the overview above, there are four tiers, each with its own respective Rewards and benefits.Each tier level is based on Program Points and Rewards earned within a 12-month period. Members will be notified via email when they achieve a new tier status. Rewards earned based on achieving a new tier status will post to Member's account. Rewards are cumulative (e.g. by spending $1,001, a Member would earn Rewards of $10, $25 and $50).Rewards expire 60 days from issuance. Rewards can be used in conjunction with other discounts or offers towards the purchase of products, not to exceed purchase amount. Please note that only three (3) Rewards may be redeemed per transaction. Further, the entire value of each Reward (e.g. $50) must be redeemed in a single transaction. The product total must exceed the amount being spent by $0.01. Further, no change/currency will be given for Reward redemptions. Rewards are not valid for redemption on prior purchases.Rewards are not redeemable for cash, and have no cash value. Rewards are non-transferable; Rewards from one Member account cannot be combined with Rewards from another Member account.Rewards may not be used towards purchase of gift card, Cigar of the Month Club, and Sprint Sale items.
Membership and its benefits are offered at the sole discretion of CIGAR.com.CIGAR.com may, in its discretion, cancel, modify, restrict, or terminate the Program or any aspects, features or Terms of the Program at any time without prior notice. Updated Program Terms will be available at CIGAR.com (see “Last Updated” above). Such changes shall become effective immediately upon posting and shall apply to unredeemed Points and Rewards, as well as Points and Rewards earned in the future. Members are responsible for remaining knowledgeable about the Program’s current Terms.These Terms shall be governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict of law provisions. Member agrees to accept personal and exclusive jurisdiction of the state or federal courts for the county of Northampton, Pennsylvania regarding any dispute arising from or related to the Program.
The interpretation and application of the Program’s Terms are at our sole discretion.
The Program is subject to all applicable laws and regulations and is void where prohibited.
Subject to these Terms, Points and Rewards earned will not expire as long as the Program continues, and the Member’s account is active. “Active” means that the Member has earned and/or redeemed Program Points or Rewards within a 12-month period, and continues to be enrolled in the Program. If no Member-initiated qualifying activity is recorded or reported within 12 months, or if you resign from the Program, your Points and Rewards will expire automatically. You can view all Program activity in the "Recent Activity" section of Elite Account Page on CIGAR.com.
The sale or barter of any Program Points or Rewards offered through the Program, other than by Cigar.com, is expressly prohibited.
By enrolling in the Program, each Member represents that he or she is of sufficient legal age to use the Program and to create binding legal obligations for any liability Member may incur as a result of such Member’s use of the Program.
You agree not to intentionally or unintentionally violate any applicable laws and regulations, or any Terms, rules or requirements established by CIGAR.com in connection with your use of the Program.
CIGAR.com will not be liable for any of the following: incorrect Registration Data or Member information; problems related to any of the equipment or programming associated with or utilized by the Member; any human error; any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission; problems relating to computer equipment, software, or inability to access the website; any other technical or non-technical error or malfunction; lost, late, stolen, illegible, incomplete, garbled, misdirected, mutilated, or postage due mail, or other mail for whatever reason.
This Program is only open to individual participants, and not to corporations or businesses. Pooling of Points or using another individual's account is considered fraudulent, and may result in the loss of all Points.
The failure of CIGAR.com to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
To resolve any account discrepancies, Members must contact CIGAR.com in writing within 60 days following the transaction in question by mail, or using the Customer Service form. Members must provide CIGAR.com with sufficient written documentation of the transaction(s) in question. Written requests must also include the Member's name, Membership Number, address, email, and daytime telephone number. Submit written requests to: 1911 Spillman Dr. Dept. #26, Bethlehem, PA 18015. In the case of a dispute regarding the Program, CIGAR.com’s decision will be final.
